Application for Shellfisih Aquaculture Leases-Maryland Water Holdings, LLC
St. Clements Bay and Chesapeake Bay
The Secretary of Maryland Department of Natural Resources (DNR), pursuant to Natural Resources Article, §4-11A-09(g), Annotated Code of Maryland, is giving notice of applications for two shellfish aquaculture water column leases by Maryland Water Holdings, LLC in St. Clements Bay and Chesapeake Bay, St. Mary's County, Maryland.
The first proposed area, St. Clements Bay due south of Day Marker "2", contains 3 acres, more or less, and is enclosed by a line beginning at corner 1,at or near Lat. 38° 14' 20.7" N., Long. 76° 43' 28.0" W., then running 349° 5' (True), approximately 92 meters to corner 2, at or near Lat. 38° 14' 23.6" N., Long. 76° 43' 28.7" W., then running 79° 35' (True), approximately 129 meters to corner 3, at or near Lat. 38° 14' 24.5" N., Long. 76° 43' 23.5" W., then running 170° 56' (True), approximately 100 meters to corner 4, at or near Lat. 38° 14' 21.3" N., Long. 76° 43' 22.8" W., then running 262° 9' (True), approximately 128 meters to the point of beginning.
The second proposed area, north of Point Look-In on the Chesapeake Bay, contains 3.2 acres more or less and is enclosed by a line beginning at corner 1, at or near Lat. 38° 6' 12.6" N., Long. 76° 19' 59.3" W., then running 337° 6' (True), approximately 93 meters to corner 2, at or near Lat. 38° 6' 15.4" N., Long. 76° 20' 0.8" W., then running 62° 20' (True), approximately 130 meters to corner 3, at or near Lat. 38° 6' 17.4" N., Long. 76° 19' 56.1" W., then running 155° 23' (True), approximately 102 meters to corner 4, at or near Lat. 38° 6' 14.4" N., Long. 76° 19' 54.3" W., then running 246° 20' (True), approximately 133 meters to the point of beginning.
The applicant proposes to deploy rows of floating cages within each of the given areas for the purpose of culturing Eastern Oyster (Crassostrea virginica), and to harvest using methods approved by the Department. A map of the proposed lease is available below.
The Department will hold a public informational meeting upon written request from a member of the public. In addition, any person who has a specific right, duty, privilege, or interest that is different from that held by the general public and may be adversely affected by one or both of the proposed leases may file a Petition of Protest with the Department. Petitions that meet the requirements of Natural Resources Article §4-11A-09(g) shall be forwarded to the Office of Administrative Hearings for adjudication. Written requests for public informational meetings and/or Petitions of Protest must be received by the Department of Natural Resources Aquaculture Division 580 Taylor Avenue C-2 Annapolis, MD 21401 by Friday, February 15, 2013.
